“This screams of conflict,” said Judge David A. Wiseman.
He also noted there may be a possible collusion in the case of Rhiner James Aguon Tiberke, 29.
When asked by Wiseman, the victim’s mother, who is the proposed third party custodian, responded she did not know the charges leveled against the boyfriend of her daughter.
Wiseman remanded Tiberke to the custody of the Department of Corrections after the hearing.
Assistant Attorney General Tiberius Mocanu represented the government, while Assistant Public Defender Adam Miles served as counsel for Tiberke.
On June 8, 2011, Tiberke was arrested by police for slapping and chasing his partner with a machete.
The victim was carrying her infant son at the time of the incident, police said.
Police pepper-sprayed Tiberke to subdue him.
The victim told police that she, her infant son and the defendant were supposed to go to her mother’s residence in Kagman, but Tiberke said he had “to go somewhere with his boys.”
The victim told Tiberke she would leave with her son and sister.
Tiberke replied that the only way her son would leave the area would be in a casket, police said.
Court records showed that Tiberke served a 10-day jail term and was placed on one year probation for assault and battery in 2005.
Tiberke was also convicted of disturbing the peace in 2004 and was sentenced to six months imprisonment, all suspended, and placed on six months probation.
Judge Ramona V. Manglona handed down the sentences on Tiberke for the two previous cases.
