Wiseman suspended the jail sentence except for 15 years, and Santos has to serve the minimum mandatory of 10 years without parole.
Wiseman credited the time already served by Santos since his arrest on June 18, 2010. He is expected to be released on June 28, 2025.
Santos, 22, will be placed on supervised probation for the remaining term of his suspended sentence and will register as a sex offender.
Santos will submit to an HIV testing, write a letter of apology, containing 50 words to his victim and her family within 30 days of his release, and he will not have any contact with his victim or her family, or with any minor children without the presence of an adult.
Santos will pay a $5,000 fine, a $100 court assessment fee, a probation fee, restitution if appropriate in an amount to be determined by the court.
Santos will complete 500 hours of community work and pay any future psychological evaluation/counseling/treatment costs incurred by the victim, if any, Wiseman said.
“The acts underlying the offense in this case were horrific, outrageous, depraved and constitute an affront to the dignity of human nature and cannot be tolerated in any civilized society,” Wiseman said in his ruling yesterday.
Assistant Attorney General Brian D. Gallagher, who prosecuted the case, declined to comment, saying “it is still an active case.”
Gallagher recommended 30 years imprisonment.
Defense attorney Joseph Camacho said: “We appreciate and respect the judge’s sentencing.”
Camacho said his client continues his willingness to cooperate with the CNMI government in investigating and prosecuting the case.
He added that his client “served only as a lookout and never physically participated in the sexual assault committed by the three other defendants.”
Camacho said his client is hoping that by his cooperating with the government the victim and her family will have “some justice.”
The case against the other defendants has been dismissed without prejudice. This means that the government can re-file the charges against Alfred P. Hocog, 18; Ivan Jones Castro, 33; and Joseph Cabrera Camacho Jr., 31.
They have denied the charges.
