Attorney Vicente T. Salas, who is representing complainant Quirino G. Adlaon, and Attorney General Edward T. Buckingham and Assistant Attorney General James T. Mitchell, who are serving as counsels for the CNMI government, have asked the federal court to dismiss with prejudice the pending legal action.
“The parties have by agreement and statutory authority come to a mutually satisfactory disposition of the various claims contained in the within entitled action,” the stipulation stated.
Salas signed the stipulation on May 10, while Buckingham and Mitchell signed it on May 5.
Adlaon said he broke his tooth after Department of Corrections Officer Jesse Reyes Babauta punched him in Jan. 2009.
Adlaon, through attorney Vicente Salas, sued Babauta, 33, in federal court and former Corrections Commissioner Dolores San Nicolas, Corrections Director Gregory F. Castro, former Department of Public Safety Commissioner Santiago Tudela, Police Officers Patrick Maanao, Jesse Cepeda and Roque Camacho.
The defendants were sued individually and in their official capacities.
Adlaon also sued the CNMI government, DPS, Corrections and 10 Does.
The amount in controversy exceeds $75,000, Salas said.
Authorities told Adlaon that he was being jailed for reckless driving and DUI.
