Businesses reminded of CNMI law regarding reduction in force and closure notices

(CNMI DOL) — The CNMI Department of Labor is reminding all employers that timely communication with the Department and affected employees is required in the event of a Reduction in Force or business closure, as outlined in § 80-20.1-240 of the CNMI Administrative Code.

There is no longer a need to visit the department in person. Employers can complete the entire process online through the form available at labor.cnmi.gov under Resources in the Forms and Publications section. 

Under CNMI labor regulations:

Businesses must provide written notice to the CNMI Department of Labor at least 60 days prior to a planned RIF or closure.

Affected employees must be given written notice at least 30 days before the effective date of the RIF or closure.

Once a business submits a notice through the online portal, the Department will activate its Rapid Response process to assist affected U.S. workers with job placement, retraining opportunities, and transition support services.

The Department emphasizes that failure to comply with these requirements may result in penalties and legal consequences under CNMI labor laws. Employers are encouraged to plan proactively and use the online submission system to ensure compliance and transparency during workforce transitions.
