Man in traffic-stop incident charged with child neglect

SAMMY Kapileo, who was previously charged for eluding the police after a traffic stop, is facing new charges for not registering his four minor children for school for two years.

Superior Court Clerk of Court Patrick Diaz on Tuesday issued a penal summons against Kapileo, directing him to appear before Presiding Judge Roberto C. Naraja on June 17 at 9 a.m.

Kapileo, 49, is accused of four counts of child neglect.

According to the information filed against him, “On or about August 2022 to June 2024 on Saipan … Sammy Christopher I. Kapileo did, through willful or negligent act or omission, failed to provide (four minors: household members) with adequate supervision with the result that [each] child’s physical or mental health and well-being were harmed or threatened, to wit: Defendant did not register (four minors) for School Year 2022-2023 and School Year 2023-2024, in violation of 6 CMC 5312(c).”

In addition, Kapileo does not want his children to be vaccinated for Covid-19, Variety learned.

Other case

In his other case, Kapileo, was charged with assault and battery, assault with a dangerous weapon, obstruction of justice, vandalism, fleeing to elude police officers, resisting arrest and reckless driving.

On June 3, before Superior Court Associate Judge Joseph N. Camacho, Kapileo, represented by Assistant Public Defender Karie Comstock, waived the reading of the information and of his constitutional rights, and entered a plea of not guilty.

Judge Camacho set a bench trial for Sept. 4 at 10 a.m.

Assistant Attorney General Heather Barcinas appeared for the government.

In this case, Kapileo was pulled over by a police officer for making an unsafe lane change to the inner southbound lane on Middle Road.

Kapileo stopped in front of the United States Courthouse and when a police officer approached him, he yelled, “What? What do you mean unsafe? Did anyone get hurt? Why did you stop me?”

When asked for his driver’s license and car registration, Kapileo drove to the courthouse’s parking lot and parked his car.

Two more police officers arrived at the scene. According to the prosecution, when the officers approached Kapileo, he backed up his vehicle, hitting a police car. This prompted a police officer to try to open Kapileo’s front door to stop him. Kapileo backed up again, knocking a police officer to the ground, then drove off before stopping again in front of the courthouse.

DPS Highway Patrol Division supervisor Sgt. Adrian Mendiola arrived at the scene, approached Kapileo and asked for his car registration. Kapileo handed the registration to Mendiola who gave it to a police officer.

Mendiola asked Kapileo to step out of his car, but Kapileo refused, rolled up his window and shouted at Mendiola.

When he rolled down his window, Mendiola tried to open the door, but Kapileo backed up again into the same police officer’s vehicle then drove forward.

Deleon Guerrero tried to open Kapileo’s passenger door, but Kapileo backed up again and hit another car.

This prompted the police officers to draw their firearms and told Kapileo to stop, but Kapileo did not comply. He instead drove faster, almost hitting the officers. He was arrested when he finally stopped his car.

Later, after posting an unsecured bond in the amount of $25,000, he was released to a third-party custodian.
