HAGÅTÑA (The Guam Daily Post) — A man was accused of repeatedly sexually assaulting a 15-year-old.
On Sunday, Guam Police Department officers responded to a criminal sexual conduct complaint reported by two females, a 19-year-old and a 15-year-old. According to a magistrate’s complaint filed in the Superior Court of Guam, the 15-year-old girl accused Johnny Nicolas Santos of sexually assaulting her while she was asleep earlier that day.
The minor reported she told officers she woke up to Santos allegedly rubbing her inner thigh, and when the minor tried to get up, Santos held her down and continued to rub her inner thigh.
“The defendant asked (the minor) if she remembered what happened ‘the last time,’” the complaint stated, adding the minor reported that she ran to another room and called the 19-year-old female.
The minor, who is in the ninth grade, then indicated Santos sexually assaulted her on two other occasions when she was in the seventh grade.
According to the complaint, the first time the minor was asleep when she woke up to Santos unbuttoning her pants and feeling Santos allegedly rubbing her primary genital area. The minor then pushed Santos and ran out of the room.
In the second incident, which allegedly occurred during the summer after the minor was in seventh grade, the 15-year-old girl was sleeping when she woke up to Santos touching her inner thigh.
“(The minor) tried to push the defendant away, but the defendant was too strong. The defendant turned (the minor) onto her stomach and pulled her pants down,” according to the complaint, which added Santos allegedly raped the minor.
“(The minor) immediately informed her parents what happened. Both of (the minor’s) parents told her not to say anything,” the complaint stated.
The 19-year-old also reported to police that Santos allegedly rubbed her leg and inner thigh when she was 16. She then saw Santos with his pants down and “stroking his penis” before running out of his room, according to the complaint.
Santos was charged with three counts of second-degree criminal sexual conduct as first-degree felonies and third-degree criminal sexual conduct as a second-degree felony.
Santos is on pretrial release for a 2022 felony case where he faces charges of theft, possession of a Schedule II controlled substance and fraudulent use of a license plate, so his new charge stemming from the incident reported over the weekend carries a notice of felony while on felony release.
