Man accused of sexual assault days after turning 18

HAGÅTÑA (The Guam Daily Post) — A man was accused of sexually assaulting an 18-year-old woman two days after his own 18th birthday

Guam Police Department officers responded Thursday morning to a criminal sexual conduct complaint reported at a local high school, where they met with an 18-year-old woman who accused Kyle Aguon Martinez of sexually assaulting her, a magistrate’s complaint stated.

According to the complaint, Martinez, who turned 18 on Monday, was with the victim on Wednesday, “hanging out” at Chamorro Village before they separated.

“While the victim was walking, the Defendant was behind her. The victim then felt both of his hands on her buttocks and that she felt the tips of the Defendant’s fingers squeezing her buttocks. The victim told the Defendant, ‘Kyle, No.’ The Defendant responded that he did not care,” the complaint stated.

The victim also said she told Martinez “no” when Martinez allegedly kissed her cheek and neck while they were walking, according to the complaint.

Later that evening, about 9 p.m., Martinez allegedly “placed his right hand under the woman’s breast and pushed up” when the victim said “Kyle, NO” again. According to the complaint, Martinez laughed in response and they continued to walk.

The victim told officers Martinez’s alleged actions made her feel uncomfortable.

When interviewed by police, Martinez allegedly admitted to touching the victim’s buttocks and that the victim said “no,” but he denied touching the woman’s breast.

According to the complaint, Martinez was arrested about two hours after the police arrived at the local high school.

Martinez was charged with two counts of fourth-degree criminal sexual conduct as misdemeanors and harassment as a petty misdemeanor.
