UNITED States Labor Secretary Elaine L. Chao on Friday filed a lawsuit against Tinian Dynasty Hotel and Casino and one of its officers for alleged violation of federal labor law.
Chao sued Hong Kong Entertainment (Overseas) Investment Ltd., owner of Tinian Dynasty Hotel and Casino, and Man Kwan for allegedly violating the provisions of the Fair Labor Standards Act.
Chao, through attorney Barbara A. Matthews, filed the lawsuit before the local U.S. District Court on behalf of 436 current and former employees of Tinian Dynasty.
Anthony Long, counsel for Tinian Dynasty, was not available for comment yesterday.
Chao asked the court to issue an order permanently enjoining and restraining defendants and their agents from violating the law.
She also sought a judgment finding defendants liable for any unpaid back wages that may be found by the court to be due to current and former employees, plus an additional amount equal to any back wages and liquidated damages.
Matthews alleged that the defendants violated provisions of the Fair Labor Standards Act “by employing employees for workweeks longer than 40 hours without compensating said employees for their employment in excess of 40 hours in such work weeks at rates not less than one and one-half times the regular rates at which they were employed.”
The defendants violated provisions of the Fair Labor Standards Act “by failing to maintain, keep, make available and preserve records of employees and of the wages, hours and other conditions and practices of employment maintained,” Matthews further alleged.
