Ex-gov’t official sues Outrigger Guam

A FORMER member of the Northern Marianas Retirement Fund board of trustees yesterday sued Outrigger Guam Resort. He said he was injured when he slipped in the hotel’s shower room two years ago.

Charles P. Reyes, through attorney Edward C. Arriola, sued Outrigger Guam L.P. for alleged negligence.

Reyes asked the CNMI Superior Court to order the hotel to pay him $74,950 in compensatory damages plus interests for his pain, suffering, emotional distress and medical expenses.

According to Arriola, a Pacific Region Investment Conference was held at Outrigger Guam Resort in Tumon from May 24 to 26, 2000.

Arriola said Outrigger Guam provided special accommodation rates for the conference guests and participants.

The hotel provided brochures to Retirement Fund trustees to attract, solicit, and induce the Fund’s employees and board members to attend the conference.

On May 25, 2000, at 6:45 a.m., Reyes, who was among the guests, took a shower and used soap and shampoo provided by the hotel.

Arriola said while his client was rinsing the soap and shampoo off his body, “he slipped and fell violently to the corner of the bathtub.”

The lawyer said his client suffered injuries to the elbow, shoulder and head.

“The bathtub constituted a dangerous condition which was known, or should have known, to defendant. In permitting guests to use the bathtub without warning them of the slippery condition and without installing anti-slip material, defendant was reckless, careless and negligent,” Arriola said.
