Former DYA detainees accused of sexually assaulting other detainee, 14

HAGÅTÑA (The Guam Daily Post) — Two men, 18 and 19 years old, who were formerly detainees at the Department of Youth Affairs were accused of sexually assaulting another male detainee from April to October 2023.

Gabereile Ferreira and Timo-Ju Daniel Palik each were charged Thursday in the Superior Court of Guam with two counts of first-degree criminal sexual conduct as first-degree felonies.

According to the magistrate’s complaint filed Thursday with the court, charges stem from a complaint made to police on Nov. 9, 2023, by a 14-year-old boy who said he was sexually assaulted by two other detainees while he was detained at the Department of Youth Affairs.

Ferreira, who was approximately 17 or 18 at the time, and Palik, who was 18 or 19, were identified as the suspects by the accuser.

According to the complaint, Ferreira allegedly followed the accuser into the restroom, pushed the victim into the wall and attempted to pull the victim’s pants down “but was unable to accomplish the act.” In another incident, Ferreira and Palik followed the victim into the bathroom, where Palik pushed the victim into the wall and Ferreira pulled the victim’s pants down, the complaint stated.

Ferreira then sexually assaulted the victim and threatened the victim not to tell, the complaint stated.

About a week later, the victim was in his cell when Ferreira and Palik entered. Palik held the victim down into a mattress and pulled the victim’s pants down. Ferreira allegedly sexually assaulted the victim and again threatened the victim not to tell, according to the complaint.

After Ferreira was charged, DYA issued a press release stating the department is “fully cooperating” with the Guam Police Department’s investigation into the incidents.

“DYA has been made aware of an ongoing criminal sexual conduct investigation involving former residents. DYA is fully cooperating with GPD’s investigators regarding the allegations made. DYA has no further comments due to the sensitivity and integrity for the ongoing investigations and legal proceedings,” DYA said in the release.
