Dear People of the Commonwealth of the Northern Mariana Islands

I AM writing to you today to address the importance of House Bill 23-22, which aims to codify Investigative Subpoena Powers to the Office of the Attorney General. The Attorney General is the highest legal office in our Commonwealth and has the responsibility to investigate and prosecute all crimes.

Unfortunately, our law does not currently expressly set out the authority for the Attorney General to issue subpoenas for investigations. Instead, the Attorney General must rely on the Office of Public Auditor and the cooperation of government agencies and local businesses to provide information relevant to an investigation. This is a time-consuming process and often hinders the Attorney General’s ability to act swiftly in cases of public abuse or corruption.

The Investigative Subpoena Power is essential for the Attorney General to carry out the criminal investigative duties  effectively.  First,  the  Attorney General  could  then  gather  crucial  evidence  and  information  during investigations. Second, the Attorney General can uncover the truth by compelling reluctant witnesses or entities to cooperate, thereby ensuring accountability and transparency. Third, Investigative Subpoena Power contributes to maintaining the integrity of the legal system by providing the necessary tools to fulfill the role of the chief law enforcement officer.

By addressing systemic problems, we can improve the overall functioning of our legal system, ensuring that justice is served promptly and effectively. By providing the Attorney General with Investigative Subpoena Powers, we align with the principles of equal protection under the law and the pursuit of justice, working towards a legal system that upholds these fundamental principles.

By the passing of House Bill 23-22, we can empower the Attorney General to carry out its duties effectively and efficiently, leading to a more trustworthy and reliable legal system. The House has done its part in that process. Please contact your Senator and encourage the final passage of this important piece of legislation. Senate President Edith Deleon Guerrero, we call upon you to be a leader and call up this bill for a vote!
