IPI ordered to appear in court regarding unpaid judgment

THE District Court for the NMI on Thursday ordered Imperial Pacific International to appear at 1:30 p.m. on Dec. 21, 2023, and tell the court if it can pay the judgment due to Tang’s Corporation.

Senior Judge Alex Munson set the hearing after Tang’s filed a motion for an order in aid of judgment on Nov. 7, saying that IPI had not made any payment to satisfy the judgment that ordered the casino investor to pay Tang’s $78,983.76 plus post-judgment interest.

IPI was also ordered to pay the plaintiff $191,070.56 in fees and charges owed to the Department of Public Lands.

In addition, IPI was ordered to take possession of the construction debris piled at the Marpi landfill.

In 2016, Tang’s Corp. and IPI entered into an agreement for the removal of construction debris from the casino resort construction site and storing it for disposal at IPI’s expense.

In its lawsuit, Tang’s said IPI failed to pay the amounts owed under the agreement.

As for the motion filed by the San Nicolas Law Office LLC to withdraw as IPI’s counsel, the court on Thursday said it had “not yet granted it, such that Joey P. San Nicolas remains as IPI’s counsel in this matter and should inform his client as to the current posture of this case, which includes this instant order.”

San Nicolas on Tuesday filed a motion withdrawing as counsel for IPI in the lawsuit filed by Tang’s, stating that the basis for the motion “is that professional considerations warrant withdrawal.”
