Seiichi Aoki appeared in court with his counsel George Hasselback and entered a guilty plea to the charges.
Assistant Attorney General Rebecca Warfield represented the government.
Associate Judge David A. Wiseman accepted the defendant’s guilty plea and sentenced him to one year jail term for each of the three offenses, to run concurrently and with credit for time already served.
Aoki will be turned over to the federal immigration authorities for removal from the CNMI following his release from the Department of Corrections on Apr. 19, 2009.
He will pay an assessment fee of $100, but no probation fee is required as he will be deported after his jail term.
Based on the affidavit of Detective Abraham C. Villagomez, the Department of Public Safety received a call reporting the presence of an intruder in a house at 8:41 p.m. on May 25, 2008.
Police officers who responded to the scene noticed that the lights in one house were turned off when they arrived but they saw the blinds of one of the windows open and close when they were near the residence.
The police officers entered the house and asked if somebody was there.
The respondent came out of the bedroom window wearing a baseball cap and smiled at them.
The police learned that it was not the defendant’s residence and that he entered through the bathroom window.
In September last year, the defendant was also charged with theft, resisting arrest and obstruction of justice after he was caught inside a house in San Vicente with some of the owner’s belongings.
Police said the defendant smelled of alcohol and when he was walking toward the police car, he suddenly dropped to the ground and would not get up. An officer had to carry him to a police car.
As the police car turned in an intersection near DPS, the defendant jumped out. Police had to chase him and strap a seat belt on him.
