Canfield Borja appeared for a plea hearing and entered a plea guilty to two counts of assault and battery with a dangerous weapon.
Borja was represented by Chief Public Defender Garth Backe while Assistant Attorney General Michael Copeland appeared on behalf of the government.Chief Justice Arthur Ngiraklsong accepted the defendant’s plea and set the sentencing for December 5 at 10 a.m. at the Melekeok courtroom.The plea agreement stated that the maximum sentence for assault and battery with a dangerous weapon is five years imprisonment and a fine of $1,000.Theplea agreement stated that Borja will be sentenced to three years of imprisonment but all suspended except for 30 days to be served in the court’s discretion.The defendant will be placed on active probation during the term of his suspended sentence.The agreement also stated that Borja will be evaluated at the Bedochel Clinic for anger management problems and shall attend and complete any treatment programs recommended by its counselors.The plea agreement stated that defendant shall not harass the victims and to obey all laws.The plea agreement stated that if defendant fail to abide the said conditions, his suspended sentence will be revoked.
