SUPERIOR Court Associate Judge Kenneth L. Govendo has sentenced five individuals in separate cases of theft, assault and battery, and driving under the influence of alcohol.
For theft, Alfonso Mendiola was sentenced on Thursday to one-year imprisonment, all suspended except for three days.
Mendiola, 38, was given one-day credit for time already served, and was ordered to pay a fine and court costs in the total amount of $125.
He will be placed under supervised probation for one year beginning on Jan. 15, 2023, and shall pay a $120 probation fee and perform 40 hours of community work service at a rate of no fewer than eight hours per month, which may be converted to a fine.
Judge Govendo also ordered Mendiola to stay away from Joeten Susupe.
Mendiola was represented by Chief Public Defender Douglas Hartig while Assistant Attorney General Heather Barcinas appeared for the government.
Another theft case
In a separate order on Thursday, Judge Govendo sentenced James Anthony Palacios Webb to 90 days’ imprisonment for theft, all suspended with credit of one day for time already served.
Webb will no longer serve any prison time and was immediately placed under adult supervision starting Thursday, Jan. 12.
Judge Govendo ordered Webb, 32, to pay a fine and court costs in the total amount of $125.
In addition, Webb will be under supervised probation for one year and shall pay a $120 probation fee.
Judge Govendo also ordered Webb to pay restitution in the amount of $7.50 to 99 Cents Market. He was likewise ordered to avoid being on the premises of 99 Cents Market.
Webb was represented by Assistant Public Defender Emily Thomsen during the court hearing while Assistant Attorney General Heather Barcinas appeared for the government.
Domestic violence
Olivier L. Especa, represented by Chief Public Defender Douglas Hartig, pled guilty to assault and battery-domestic violence and was sentenced on Thursday by Judge Govendo to one-year imprisonment, all suspended except for 14 days not subject to parole, early release or work release.
Especa, 33, was also given two days’ credit for time already served.
Judge Govendo ordered Especa to report to the Department of Corrections to begin his sentence on Thursday at 2:30 p.m. Especa shall be released on Jan. 24, at 2:30 p.m.
He was ordered to pay a fine of $400 and court costs of $25.
Especa will also be placed under supervised probation for one year and shall pay a $120 probation fee.
The judge warned him not to have any abusive, harassing or illegal contact with the victim.
Assistant Attorney General Heather Barcinas appeared for the government during the court proceedings.
DUIs
On Wednesday, Jan. 10, Judge Govendo separately sentenced Carson Chutin, and Elais K. Osiik to four days in jail for driving while under the influence of alcohol.
Both defendants were given 12 hours credit for time already served.
Osiik was ordered to report to Corrections on Jan. 12 at 9 a.m. while Chutin was ordered to report to Corrections on Feb. 24 at 6 p.m.
Osiik will be released on Jan. 15 at 9 p.m. while Chutin and will be released on Feb. 28 at 6 p.m.
Chutin was ordered to pay a $500 fine while Osiik will pay a $650 fine and shall attend an alcohol information class.
Both will be under probation for one year and each shall perform 40 hours of community work service.
Moreover, each shall pay $145 in probation fees and court costs.
At the hearing, Osiik and Chutin were represented by Chief Public Defender Douglas Hartig while Assistant Attorney General Dejon Redd appeared for the government.
