Man on probation gets 12 months for assault

SUPERIOR Court Associate Judge Joseph N. Camacho has sentenced Lee Roy Camacho Villagomez to over 19 months in prison, six months and 45 days of which are suspended, for assaulting another person while on probation.

Villagomez, 37, on July 13, 2022, pled guilty to assault and battery, and disturbing the peace, in criminal case No. 14-0120, and violation of probation, in criminal case No. 13-0209.

On the same day, Judge Camacho sentenced Villagomez to 12 months imprisonment for assault and battery, with the first six months to be served day for day without the possibility of parole.

Villagomez was also sentenced to six months imprisonment for disturbing the peace, but all suspended, to be served consecutively with the sentence for assault and battery.

Villagomez was ordered to pay a $200 fine and $25 in costs. He will also be placed on probation for three years beginning immediately after serving his sentence.

As for the probation violation, Judge Camacho sentenced Villagomez to 45 days imprisonment, all suspended.

After the hearing, Villagomez was taken into custody to start serving his sentence at the Department of Corrections.

Villagomez was represented by attorney Joey San Nicolas while Assistant Attorney General Steven Kessel appeared for the government.

Judge Camacho’s judgment and commitment order noted that on Aug. 14, 2014, Villagomez was found guilty of disturbing the peace and was sentenced to six months imprisonment, all suspended except for 15 days, with credit for 15 days of time already served.

In that case, Villagomez was placed on probation for six months subject to conditions which included the condition that he obey all CNMI, state and federal laws.

But on Nov. 10, 2014, during the period of his probation, Villagomez was charged with several new criminal violations including assault with a dangerous weapon, aggravated assault, assault and battery, and disturbing the peace.
