U.S. District Court for NMI Chief Judge Alex R. Munson said the jury trial of 41-year-old Yong Ming Song will start on Feb. 23 instead of the original schedule set for Jan. 12, 2009.
He said all motions should be filed no later than one week before the trial.
The court finds that the ends of justice will be served by allowing the defense more time to review the evidence.
Song, an employee of Rifu Garment Factory in San Vicente, was arrested by police after a search of his vehicle yielded a huge haul of ice on Sept. 11, 2008.
He was indicted for possession of a controlled substance within 1,000 feet of a school with intent to distribute.
The indictment stated that Song was found in possession of 138 grams of ice within 1,000 feet of Marianas High School.
He pleaded not guilty during his arraignment
A special agent of the Drug Enforcement Administration stated in his report that at about 10:40 p.m. on Sept. 11, Police Sgt. Anthony Macaranas and Police Officer Daniel Punimata were patrolling along Beach Road in San Jose when they saw a white Toyota Corolla driving south.
The driver, who turned out to be the defendant was not wearing a seatbelt.
The police officers activated the car’s emergency lights and stopped the vehicle.
The officers noticed that Song was sweating and was very nervous when he handed over the documents the police requested. A search inside the vehicle led to the recovery of a large plastic bag with three Oil of Olay soap boxes that had been opened and taped shut. Inside the taped soap boxes were 15 small Ziplock bags containing ice.
