Construction firm sues water supplier for bad check

Construction & Material Supply Inc. through its lawyer Michael A. White filed the complaint in Superior Court against Saipan Ice and its president Kim Kyong Tuh.

The plaintiff wants to be awarded judgment for the principal sum of $9,745, plus 12 percent interest from July 25, 2008, for reasonable attorney’s fees, court costs and for interest on the total at the maximum rate provided by law from the date of judgment.

The plaintiff stated in its complaint that the defendants issued a check payable to plaintiff on July 25, 2008 amounting to $9,030.00.

When the plaintiff deposited the check to its bank account, it was returned for insufficient funds.

On Nov. 21, 2008, the plaintiff sent a demand letter through certified mail to the defendants asking for payment of the check

In its demand letter, White stated that under the provisions of the commonwealth law, “failure to pay the check amount together with any lawful charges within 90 days after receiving a notice may result in a court judgment for three times the amount of the check.”

The plaintiff said that the defendants failed, refused and neglected and still fail, refuse, and neglect to pay the amount.

The plaintiff added that the defendants executed a promissory note on Nov. 2, 2008 but has not made the payment now due.
