Court orders release of man in assault and battery case

During yesterday’s status conference, Associate Judge Kenneth C. Govendo reminded Benzi Ngeskebei Jr. to return to court for all scheduled hearings and obey all commonwealth laws.

Govendo ordered Ngeskebei to report to the probation office yesterday noon.

Ngekebei’s probation will expire on Nov. 29, 2010 and he will be back in court for a review hearing on Oct. 28, 2009.

The court sentenced him to 90 days jail term and two years probation on Sept. 2, 2008.

He has already paid a $100 fine, $25 in court costs and the $200 probation fee.

He has completed his 90-day jail sentence and written a letter of apology to the victims. He, however, failed to report to the Office of Adult Probation for his counseling referral.

On May 4, 2008, at 6:28 a.m. the Department of Public Safety received a call regarding a a disturbance at Lali Four beachside in Chalan Kanoa

The victim and his girlfriend were taking an early morning walk behind San Isidro Avenue when they saw the defendant, hunched down and doing something with a bushcutter behind the Silver Hotel.

The victim later saw the defendant coming out of an abandoned house behind Koreana Hotel.

The defendant accused the victim of following him and threatened to beat him up. The victim denied following the defendant who then pushed the victim to the ground.

As the victim was getting up, Ngeskebei grabbed a stick from a barbeque pit and stuck the victim on his leg, head and body, causing him to fall again.

The victim’s girlfriend called 911 for assistance while defendant kept on punching the victim’s head.

The victim was treated at the Commonwealth Health Center for two lacerations on his head. He also sustained several abrasions, scratches and bruises all over his body.
