Subpoenas issued in Julian Moti sex case

Moti, a Fijian-born Australian citizen, held the attorney general’s post between July and December 2007.

He is facing seven charges of unlawful sexual intercourse with a 13-year-old girl in 1997 in Noumea and Vanuatu.

Moti allegedly violated the Crimes Act, which states that an Australian citizen “must not, while outside Australia, engage in sexual intercourse with a person who is under 16.” The former lawyer was deported to Australia in December 2007.

During a brief review in the Queensland Supreme Court, barrister Craig Chowdhury, for the Commonwealth Director of Public Prosecutions, said Moti’s lawyers had subpoenaed the Department of Foreign Affairs and Trade, the Australian Federal Police, the Australian Secret Intelligence Service and AusAID.

Chowdhury said there would “probably be some argument” from the CDPP over those subpoenas when the matter was next before the court.

Moti’s barrister, Ken Averre, said his client was preparing an affidavit to support a stay application.
