Car crash survivor arrested for theft

Associate Judge Kenneth L. Govendo issued a warrant of arrest for Calvin A. Fitial and recommended a cash bail of $50,000.

Fitial was charged with burglary, theft, forgery, theft by deception and theft of service.

In his affidavit, Detective Christopher Leon Guerrero stated that a woman contacted the Department of Public Safety at about 6:31 p.m. on April 16, 2009 reporting a theft incident at Taga Mart in San Vicente, KL Market in Koblerville, and TM Sablan Company in Chalan Piao.

The victim’s debit card was illegally used to purchase over $350 worth of merchandise.

Leon Guerrero said DPS received another call from another female at 6:37 p.m. on the same day reporting a burglary/theft incident from a patient in Room C-20 of the Commonwealth Health Center in Garapan.

Three First Hawaiian Bank debit cards, one silver Sony digital camera, a personal check wallet and a driver’s license were stolen.

The debit card was later used at several locations.  

Leon Guerrero said he responded to the KL Market incident in Koblerville and met with the store owner who showed him footage of the surveillance camera.

Leon Guerrero said recognized the suspect in the footage.

On April 17, Leon Guerrero visited Taga Mart and met the owner who informed him that a man purchased  beer and rice using the stolen debit card.

The suspect used the debit card to obtain $100 in cash from Kiana’s Salon & Spa on the same day.

The suspect also got $100 each  from KL Market, Taga Mart and Kevin International using the debit card.

Three witnesses later positively identified Fital from a line up photo of six people.

Leon Guerrero also met with the second victim and learned that he underwent surgery at CHC for hernia.

He said he lost a wrist watch worth $500 in addition to his wallet, camera and debit cards.

Leon Guerrero learned that Fitial was in the next room to visit another patient who was also involved in the vehicular accident in Dandan last month.

On May 4, the Shell has station in Koblerville reported a theft of service and theft by deception after Fitial tried to use a stolen debit card. He left without paying for $20 worth of gasoline.
