Presiding Judge Robert C. Naraja also placed 22-year old Tarek Barhoum under several court conditions if he posts bail, including returning to court whenever required to do so and obeying all Commonwealth laws.
He must also surrender all travel documents and not leave Rota without permission from the court, keep all appointments with his lawyer and shall have no direct or indirect contact with the victims.
The court found that probable cause exists to charge the defendant with aggravated assault, assault with a dangerous weapon, assault and battery, and disturbing the peace.
The defendant was represented by assistant public defender Matthew Holley for the bail hearing yesterday.
Assistant Attorney General William Downer appeared on behalf of the government.
If he is released from the custody of the Department of Corrections, the arraignment set for July 27 will be at the Rota calendar.
The preliminary hearing is set for July 23 at 9 a.m.
Detective Francis B. Manglona stated in his affidavit that the Department of Public Safety Central received a call reporting a possible fight going on next to Harvest Market in Songsong Village, Rota at about 12:30 p.m. last July 14.
Manglona said the responding police officer met the defendant who admitted hitting two men with a baseball hat.
Police arrested the defendant and transported him to the DPS central office for processing. The victims, identified as Anthony Reyes and Alan Reyes were transported to Rota Health Center for treatment.
Anthony Reyes told police that he and his brother Alan were at his brother’s girlfriend’s house for lunch break when he saw the defendant’s mountain bike. Reyes told police that he decided to hide the defendant’s bike and make him find it to get even over a fight they had on the evening of July 11.
He said he received a black eye but the fight was not reported to the police.
Reyes said he and his brother carried the defendant’s bike behind Perpetual Help Chapel but the defendant happened to pass by driving a white sedan.
He said the defendant confronted them and he punched the defendant’s face.
Reyes added he and the defendant got into a fight but when he said they should stop and go home, the defendant went to his car and got as baseball hat.
The defendant then chased him and hit him and his brother with the baseball bat several times.
Alan Reyes sustained a fractured bone on his left forearm. Both brothers sustained several bruises.
