At the same time, Torres, R-Saipan, urged NMC to be transparent about its expenditures.
In an interview on Friday, Torres said NMC should clarify the $531,643 contractual services it declared under its stated in expenditures.
“Are these legal fees? How much money did they pay for employment settlement?” he asked.
The NMC statement of revenue and expenditures from Oct. 1, 2007 to Sept. 30, 2008 showed $823,178 as other expenditures.
Torres is asking whether these expenditures are employment settlements made by the College.
In his letter to NMC President Dr. Carmen Fernandez, Torres said the college should respond to his request to make or create such records for inspection whether it likes it or not.
But Fernandez said the documents that Torres requested which includes employment records, are exempt from public disclosure under the law.
Last June 12, Torres wrote NMC Board of Regents chair Charles Cepeda to avoid any unnecessary litigation.
Cepeda responded saying he has no custody or control over the documents being asked.
He said he was informed by Fernandez and the college’s counsel that the documents he requested are not subject to disclosure under the Open Government Act.
In its unaudited financial statement, NMC posted $15.6 million in total revenues against $14.7 in total expenditures. It has $890,199 net revenue over expenditures.
The NMC also posted in its balance sheet as of Sept. 30, 2008 $21.1 million total assets and $7.4 million total liabilities.
Its fund equity was $13.6 million.
