SENATE Vice President Donald M. Manglona has prefiled Senate Bill 23-41 which would exempt the Office of the Attorney General from civil service rules in hiring employees.
The bill said it will ensure the autonomy of the OAG, which became an elected, independent office through House Legislative Initiative 17-2, approved by voters in 2012.
S.B. 23-41 proposes to allow the OAG to hire employees necessary to carry out its responsibilities, including administrative staff and attorneys who will be exempt from the civil service hiring rules. The hiring of these employees will be governed by the personnel rules and regulations of the OAG, the bill added.
The bill provides for a transition period. It states that until the effective date of the adoption of the OAG’s own personnel rules and regulations, the statutes and rules of the civil service system shall continue to apply to the OAG.
After the OAG’s personnel regulations take effect, its employees presently in classified civil service positions will have the option to remain civil service employees or convert to the new personnel system, the bill stated.
Once such positions become vacant, these employees will no longer be classified positions in the civil service system, and the new employees in those positions shall be subject to the new personnel regulations of the OAG, the bill stated.
