The complaint for injunction, conversion, accounting, trespass and damages was filed by Rota Ansarul Muslim Musqui Community, or RAMMC, against Muhammad Edris Monsi, Muhammad Alamgir Rary, Billal Hossain, Harunor Rasid, Adbud Kuddus, Muhammad Khalil, Lokman Saiyel, Nuzzrul Islim, Abdul Mannan, Rana Billal, Akter Hossain, Siraz Chakider, and Mir Azad Rahaman.
Attorney Ramon K. Quichocho represents the plaintiff.
The plaintiff is asking the court to issue a temporary restraining order, a preliminary injunction and a permanent injunction restraining defendants Monsi, Rary, Billal, Hossain and Rasid from using the RAMMC name and misrepresenting RAMMC in their transactions.
The plaintiff is also asking for an award of exemplary damages against the defendants, for a temporary restraining order to refrain the defendants from coming within 100 meters of the mosque, or from contacting, molesting or disturbing the peace of the plaintiff, its officers or directors.
The plaintiff is asking the court to order the defendants to present accounting of all proceeds they collected, general and exemplary damages according to law, punitive damages, costs of suit and attorney’s fees and other relief the court may deem proper.
The plaintiff is filing five causes of action against the defendants for injunction and damages against Monsi, Rary, Hossain and Rasid and is asking the court to order the defendants to stop using the name RAMMC to deceive the Muslim community and the general public, and to stop using the name in all their transactions and dealings, or use the facilities of RAMMC including the mosque.
The plaintiff is also filing for injunction and damages against all defendants, for trespass, for conversion, and for accounting.
The plaintiff said the defendants failed to render an account and statement of all the money they have collected as membership and solicitation fees they have received using the plaintiff’s name.
According to the complaint, Monsi has been misrepresenting himself as the president and director of RAMMC, Rary and Hossain as vice presidents and directors, and Rasid as the treasurer.
The plaintiff said all 13 defendants cooperated in misusing and trespassing on the RAMMC’s mosque or house of worship.
Records show that Nurul Island Paeda founded and organized the Rota Muslim Community, or RMC, in 2001.
He built a mosque to be used by the RMC but in 2003, some renegade members of the RMC including the defendants grabbed control of the leadership and filed fraudulent documents at the Department of Commerce
To settle the matter peacefully, Paeda organized another Muslim community called the RAMMC in 2004. He was the president of the new organization.
Paeda said that on Nov. 1, 2008, the defendants, some of whom were not members of the RAMMC at that time convened an annual meeting of RAMMC.
The plaintiff said they did not approve or authorize the holding of such meeting.
The complaint stated that the defendants created minutes of the meeting and submitted a 2007 Annual Corporation Report for RAMMC to the CNMI Registrar of Corporations on Nov. 18, 2008.
The plaintiff said the defendants held the meeting and maliciously usurped the functions of the lawful officers and the name of RAMMC.
The plaintiff added that the defendants also used the mosque in Sinapalo which is devoted for the exclusive use of the legitimate RAMMC for worship.
The plaintiff added that following the unlawful meeting on Nov. 1, the defendants have been using the mosque for improper purposes like eating, lodging and even engaging in arguments and fighting on the holy grounds of the mosque.
Paeda wrote notices on the mosque reminding all to respect the place and he wrote a final notice on Nov. 25 informing the defendants that as a result of their disrespect, they should stay away from the mosque.
The defendants, however, paid no heed to Paeda’s warning. Paeda said Rahaman, who was a mosque priest, even called Rota Department of Public Safety claiming that Paeda harassed him.
