Superior Court Associate Judge Perry B. Inos imposed a $30,000 bail each on Edward M. Fleming and Marwin Borja Camacho, 10 percent or $3,000 of which will be cash and $27,000 in unsecured bond for their temporary liberty.
Inos also imposed the same bail amount on Benedicto R. Lizama, but $1,000 will be in cash and $29,000 in unsecured bond.
Inos subjected the three defendants to court conditions if they post bail.
These include returning to court whenever required and obeying all commonwealth laws. They will stay away from all airports and seaports, will not consume alcoholic beverages in public places and will keep all appointments with their attorneys.
Assistant Attorney General William Downer appeared on behalf of the government while Assistant Public Defender Matthew Holley represented the defendants.
Inos set the preliminary hearing for March 27, at 9 a.m. and the arraignment for April 6, 2009 at 9 a.m.
Based on the affidavit submitted by Detective Peter Raymond Camacho, Marwin Camacho was arrested following a buy-walk operation conducted by the Department of Public Safety’s Narcotics Unit on Jan. 22, 2009.
A cooperating source purchased $200 worth of “ice” from Camacho using pre-recorded funds.
On the afternoon of the same day, DPS conducted a second monitored buy-walk operation and purchased another $200 worth of ice from Camacho.
The cooperating source proceeded to the agreed place at a poker arcade in Dandan but it was another person who identified himself as Roger who gave the cooperating source two ziplock bags containing crystalline substance.
Roger told the source that Camacho couldn’t make it and sent him over to do the transaction.
Police later identified Roger as Juan Diego C. Matagolai.
The court has also issued a warrant of arrest for him..
In a separate affidavit, Task Force Officer Norman S. Rasiang said the DPS Narcotics Unit with the assistance of the Criminal Investigation Division conducted a buy-walk operation and purchased $200 worth of ice from Fleming through a cooperating source on Feb.12, 2009 in Dandan.
The affidavit of Detective Steven A. Castro stated that DPS Narcotics Unit and the CID conducted a buy-bust operation on Feb. 19, 2009.
He said cooperating source purchased $300 worth of ice from Lizama in San Vicente.
