Associate Judge Perry Inos ordered Guo Can Yang, a resident of San Antonio, to post 10 percent or $500 of the total bail in cash and the remaining amount in unsecured or appearance bond for his temporary release.
If he will post the bail, Guo Can Yang must return to court whenever required, not leave Saipan without court permission, stay away from seaports and airports and keep all appointments with his attorney.
He must also contact the Attorney General’s Investigation Unit three times a week as well as provide the AGIU a sketch of his residence in order for him to obtain a new passport.
Investigator John Peter filed a declaration in support of a warrantless arrest against the defendant on Jan. 8.
Peter stated that based on investigations and review of information he obtained from the Labor and Immigration Identification and Documentation System and the Border Management System, the defendant is an overstaying nonresident.
Peter stated that he responded to a call for assistance from the Department of Public Safety at 5 p.m. on Jan. 7 and met the defendant who was questioned for suspicion of copper wire theft.
He said the defendant admitted he had no pending labor case and had overstayed his stay in the CNMI.
Peter said the defendant, a citizen of the People’s Republic of China, was issued a nonresident worker’s entry permit that expired on June 18, 1999. This means that the defendant has overstayed in the CNMI for nine years and six months.
The investigator said the defendant does not have any pending labor case, was not issued any temporary work authorization, does not have any pending employment application and does not have any pending labor administrative action.
He also did not register with the Department of Labor to seek employment opportunities.
The defendant must show up in court on Jan. 22 for an order to show cause hearing.
The Attorney General’s Office and the Division of Immigration Service filed the petition for order to show cause and declaration against Guo Can Yang on Jan. 9.
The petitioners said the defendant failed to comply with the requirements or conditions of his entry and committed a violation by overstaying without lawful documentation and authority to remain in the CNMI.
