Corrections, AG’s office mum on woman’s complaint

Barcinas, a Tinian resident, lamented the lack of assistance extended to her by the Office of  Victims Rights.

Barcinas also complained that the Department of Public Safety on Tinian office allowed her former domestic partner Vicente T. Aldan, 52, to trespass on her property on Nov. 11, 2009 without her consent.

Barcinas likewise accused DPS Tinian and Corrections of abuse of authority.

Court records showed that Aldan pleaded guilty of assault for the “crime of domestic violence.”

Superior Court Associate Judge David Wiseman sentenced Aldan to six months imprisonment, without the possibility of parole.

Aldan was ordered to start serving his sentence on Dec. 7, 2009. He is expected to be released on June 7, 2010.

The court also directed Aldan to surrender the firearm he used in the crime.

After serving his term, Aldan will be on supervised probation for three years under the direction and supervision of the Office of Adult Probation.

The court also directed Aldan not to have any contact with Barcinas.

Aldan is now the husband of Corrections Commissioner Dolores San Nicolas Aldan.

“Why was the commissioner involved in this case?” Barcinas asked. “Doesn’t that present a conflict of interest on her part to be involved in protecting her interests, i.e. the interest of her spouse? She should not be involved in this case in any form.”

Barcinas added, “What is also interesting is that the case went swiftly from incident to adjudication, indicating that there’s a strong likelihood that she exerted some influence due to her official capacity to get the defendant out of jail (so they can marry), etc.? Did she also have some involvement in making sure that I did not know about the case, not made aware of the proceedings so that I can be heard, because it may delay the adjudication of the case? To what extent was she involved in getting the Tinian DPS to do her bidding, whatever that may be in reference to this case?”
