Loren Sutton, Cabrera’s counsel, said, “the [U.S.] Marshal informs that [his client’s] ticket from Guam to the CNMI was paid for by the Marshal Service and that since his case has been dismissed on motion of the United States his return ticket should likewise be paid for by the United States.”
On Friday, Presiding Judge Alex R. Munson ordered the U.S. Marshal to return Cabrera to Guam “at the Marshal’s earliest convenience.”
On Nov. 5, Designated Presiding Judge David Wiseman ordered the dismissal of Cabrera’s case after Assistant U.S. Attorney James J. Benedetto moved for its dismissal.
“The [U.S.] government may proceed with a probation revocation … in lieu of the criminal charges,” Benedetto stated in his motion to dismiss complaint against Cabrera.
Cabrera was arrested on Guam last Oct. 7 and was sent to Saipan.
Cabrera was earlier released to a joint-third party custodian. Cabrera and his custodians were ordered to post a total of $30,000 in unsecured bonds.
Cabrera’s co-defendants Jawn Joyner and Sharee Maratita, a.k.a. Sharee Demapan Diaz, were arrested last Oct. 7 for “ice” trafficking.
Munson has designated Jolene D. Benavente as temporary third-party custodian for Diaz.
Ana Castro, Diaz’s mother and designated third-party custodian, will be off-island.
