Associate Judge Kenneth L. Govendo granted the motion filed by Atalig during a bail hearing last month.
In his two-page order, Govendo said Atalig and Yana are allowed to wear civilian clothes both while in custody and when appearing before the court.
Both lawyers are ordered to report to Corrections every Wednesday at 8 a.m. and will be released from custody every Monday at 8 a.m.
Govendo also scheduled a hearing at 9 a.m. for Friday, Dec. 5, to check on the progress of the two lawyers toward satisfying the orders of the court.
Govendo ordered both lawyers to be imprisoned until they disgorge attorney’s fees totaling $1,288, 500.
In his order, the judge stated that neither Yana nor Atalig has disgorged the fees in part or in full since the contempt order was issued in March 28, 2008.
On Aug. 15, the court gave the two lawyers a few days to be released from custody each week so they could have time to prepare a detailed account of their work with the Angel Malite estate probate and work toward satisfying the orders of the court.
Yana and Atalig have been imprisoned since March 25, 2008 after Govendo found them in contempt of court in connection with the Malite probate.
