Associate Judge David A. Wiseman ordered Babul Miah to post 10 percent or $100 of the bail in cash and the remaining $900 in unsecured bond.
Wiseman told Miah that if he would post bail, he must return to court whenever required to do so, stay away from seaports and airports and report to the Immigration Office every Friday starting tomorrow.
He was also told to provide a sketch of his residence and include telephone numbers where he can be contacted.
Miah told the court that he lost his passport.
Assistant Attorney General Kathleen R. Busenkell appeared for the government.
Miah will return to the court on April 9, 2009 for a hearing to show why he should not be deported from the CNMI.
On Dec. 11, 2008, Wiseman issued an arrest warrant against Miah.
The Attorney General’s Office and the Division of Immigration Service filed the petition for order to show cause against on Dec. 9, 2008.
The petitioners said that Miah, a citizen of Bangladesh entered the commonwealth on a nonresident worker’s entry status and has failed to comply with the requirements or conditions of his entry.
In his affidavit, Immigration Investigator John Peter stated that Miah’s nonresident worker’s entry permit expired on Feb. 6, 2003.
Peter said Miah does not have any pending labor case and was not issued any temporary work authorization.
Miah also does not have any pending labor administrative action and did not register with the Labor Employment Section for further employment opportunities.
Peter said the respondent had been eluding immigration officers.
