Court orders man who failed to remit trash collections to post $5K

Wiseman on Wednesday said Ernesto Reloza may post 10 percent or $500 of the bail in cash, and the remaining $4,500 in unsecured or appearance bond.

The defendant appeared in court with Assistant Public Defender Douglas Hartig while Assistant Attorney General Mike Evangelista represented the government.

If he will post bail, Reloza was ordered to return to court whenever required, obey all commonwealth laws, surrender all travel documents and not leave Saipan.

He is also prohibited from taking any alcoholic beverages and must have no direct or indirect contact with the victim.

The court at the same time granted the request of the Public Defender’s Office to provide a Filipino translator.

Wiseman set the preliminary hearing for Nov. 12 at 9 a.m. and the arraignment for Nov. 17 at 9 a.m.

Detective Patrick Earl Maanao filed an affidavit in court stating that he was assigned to investigate a theft case on Nov. 3, 2008.

The investigation showed that on Aug. 18, 2007, an employee of TC Services, a trash collections company, reported that the defendant came to him asking for a job.

 He was hired in Jan. 2008. The investigation revealed that the defendant was a former employee of 3G Trash Services.

The defendant was assigned to continue collecting trash from former customers of the 3G Trash Collection Services and issue a receipt from TC Services.

The defendant received payments and issued receipts to customers but he failed to submit the payments to his employer, the affidavit stated.

When TC Services did an audit, it discovered that between January and April 2008, the defendant embezzled the company of $1,630. When confronted, the defendant told his employer that he sent the money to the Philippines.

Wiseman issued an arrest warrant against the defendant on Nov. 3 on charges of theft and theft by failure to make required disposition of funds received.
