Defendant in marriage fraud case gets waiver of speedy trial

The jury trial for Maria Calipay  Maderal Camacho will start on Sept. 27, 2010 as ordered by visiting Senior Judge Robert J. Bryan.

Bryan granted the motion filed by attorney Robert T. Torres on behalf of his client Camacho, saying they needed more time to prepare for trial.

Camacho had denied the charge of arranging the fraudulent marriage of her co-defendant, Crisanto Maderal Olivos.

Olivos has already pleaded guilty to one count of immigration document fraud.

Camacho and Olivos were separately arrested by federal agents last January.

Olivos’ sentencing has been rescheduled for Aug. 10, 2010.

Assistant U.S. Attorney Kirk Schuler is prosecuting the case.

According to the stipulated facts of the case, Olivos entered into a fraudulent marriage with a U.S. citizen on Sept. 14, 2001.

After five years, Olivos applied for a “green card.”

On Jan. 3, 2007, Olivos and his U.S. citizen spouse flew from Saipan to Guam to be interviewed by U.S. Customs and Immigration Services regarding his green card application.

The following day, Olivos received his green card.
