Drug convict admits drinking alcohol but breathalyzer tests negative

Jose Cruz Aldan, who is still on probation, told U.S. Probation Officer John San Nicolas II that he drank two cans of beer on the night of March 23.

On March 24, Aldan underwent his quarterly testing for alcohol, as part of the conditions of his probation.

Based on Aldan’s admission, he was returned to substance abuse testing and treatment with the contract provider for the U.S. Probation Office.

U.S. Probation Officer Maria C. Cruz declared in documents submitted to the federal court that he met with Aldan on March 31 and was told that he admitted drinking alcohol “because he wanted to be honest.”

“He was counseled to refrain from all alcohol use pursuant to the judgment imposed on Nov. 21, 2006,” Cruz stated.

Aldan who is currently employed as maintenance worker was sentenced to serve 27 months in prison and three years supervised release after he was convicted on two counts of distribution and possession with intent to distribute a controlled substance.

While on probation, Aldan is mandated to undergo at least two periodic drug tests, not to exceed eight tests per month and to refrain from drinking alcohol.

No further sanctions were sought thus far against Aldan.

But the Probation Office said he will be closely monitored and any further incidences of noncompliant behavior will be reported to the federal court.
