Ex-DPW official in theft case gets 1 year probation

Antonio Sablan Demapan, 55, was also sentenced to six months imprisonment, all suspended with credit for two days time served at the Department of Corrections facility.

He will be placed on one-year supervised released and will pay a $100 fine.

The judge described the sentence a “persuasive deterrent.”

A restitution hearing was set for Aug. 5.

The rest of the charges against Demapan, which included two counts of conspiracy, two counts of theft, two counts of theft by unlawful taking, and two counts of misconduct in public office, were dismissed.

Assistant Attorney General William Downer who prosecuted the case said the penalties imposed by the court against Demapan were “proportionate and consistent with actions [for which the defendant] pleaded guilty.”

Demapan was represented by attorney Edward Arriola.

The bench trial for Demapan’s co-defendant, businessman John Tenorio Sablan, 50, will start on May 17, 2010.

Sablan is charged with two counts of conspiracy, two counts of removal of government property, and two counts of receiving stolen property.

Court records showed that 352.6 gallons of diesel fuel which were given to DPW’s transportation automotive heavy equipment division were “donated” to Sablan’s company, JG Sablan.

A government-owned bulldozer was also transferred by DPW to Sablan without following proper procedures and without any documentation or necessary approvals.
