Fernandez hearing rescheduled

The hearing was supposed to start at 2:30 p.m. yesterday in the board’s conference room.

But the board decided to reschedule it because the meeting was not officially announced by NMC.

If they pursued the hearing yesterday, Regent Andrew Orsini said it would not be an official one.

Both parties, the legal counsel of Fernandez and the board’s lawyer, were aware that the hearing “was not announced,” Orsini said.

“We’re protecting both Fernandez and the college because it’s not an official meeting,” Orsini said, after the three-hour executive meeting.

Fernandez arrived before the scheduled hearing with her lawyer, Brien Sers Nicholas, and was greeted by NMC staff.

She and her lawyer were later informed that the hearing was postponed.

Asked for comment, Fernandez said she was advised by her lawyer not to talk about the case.

When asked why it took so long for the board to discuss the rescheduled meeting, Regent Paz C. Younis said: “We have a lot of questions.”
