Estanislao C. Villagomez was arrested by police at 8:40 p.m. on Aug. 21.
Associate Judge Kenneth L. Govendo said if Villagomez posts bail, he will return to court, obey all commonwealth and federal laws, and have no direct or indirect contact with the victims.
Assistant Attorney General George Hasselback appeared on behalf of the government while Chief Public Defender Adam Hardwicke represented the defendant.
Govendo set the preliminary hearing for Aug. 31 and the arraignment for Sept. 7.
In his affidavit, Police Officer Vincente S. Mareham said that on Jan. 11, 2009, a staff member of Child Protective Services escorted two minor children to the Department of Public Safety to lodge a complaint against the defendant.
Mareham learned that the defendant engaged in several instances of inappropriate sexual contact with the victims.
The 11-year-old victim told police that when she was nine years old, the defendant taught her how to “French kiss” and he had done it to her more than five times.
She said the defendant forced her to touch him and joined her in the shower at her grandmother’s house.
The victim said the defendant offered her money to keep the sexual abuses a secret.
Mareham the younger victim said the defendant touched her inappropriately when she was on the defendant’s vehicle sometime in the summer of 2007.
The younger victim said the defendant offered to give her sister some money if the victim would tell no one about what the defendant did.
Mareham said based on the information they have gathered, there is probable cause to support the charges of sexual abuse of a minor in the first degree and sexual abuse of a minor in the second degree against the defendant.
Mareham said as the victims are household members, the charges can be considered crimes of domestic violence.
Superior Court Presiding Judge Robert Naraja issued a warrant of arrest for the defendant on Aug. 19, 2009.
