Superior Court Associate Judge David A. Wiseman discharged Michael Blodak shortly after 4 p.m. yesterday.
“I’m ecstatic for my client,” said Chief Public Defender Adam Hardwicke, who represented Blodak.
“What my client is guilty of is having an extra-marital affair,” Hardwicke said.
He noted that the jury deliberation took only five minutes, which showed that the complaint should not have been filed in court for prosecution.
In an e-mail to the Variety, Assistant Attorney General Brian Gallagher, the prosecutor, said: “While the commonwealth is disappointed in the outcome, we appreciate the jury’s and the court’s hard work and attention to this matter. We are also quite proud of the hard work the officers and agents of the [Department of Public Safety] and the Attorney General’s Office. Regardless of the outcome in this case, the people of the Attorney General’s Office will continue to work hard to protect the people of the CNMI.”
On April 18, 2010, Blodak’s wife caught her husband and the victim having sex.
The victim said she was “scared” of her uncle, adding that this was the reason why the defendant succeeded in “raping” her.
