Rufino F. Tudela, 43, was charged with assault with a dangerous weapon, assault and disturbing the peace of Anthony Paul Tudela.
The suspect was set free after he posted a bail of $6,000.
Superior Court Associate Judge Perry Inos set Tudela’s arraignment for April 4 at 9 a.m.
Detective Jeffrey I. Norita who investigated the case said a police unit was dispatched to the victim’s residence on March 18 at 8:53 p.m. after he called for help.
“Preliminary investigation by responding officer Villagomez revealed that Anthony’s brother, Rufino Faisao Tudela, and his nephew, arrived at his home and broke several glasses, including the side mirror of his pick-up truck and was threatened,” Norita said in his written affidavit.
Norita said a person named JR who flagged down their car while responding to the scene, testified that he saw Rufino Tudela getting out of a Blue Toyota Echo and running toward the back of the black pick-up truck while holding a machete.
“At that same time, Rufino held up a machete with his right hand, gesturing the weapon in a back and forth motion, yelling out and telling Anthony, ‘I’m going to kill you,’ ” Norita said.
The suspect and his nephew fled the scene when they were distracted by a loud metal noise.
The victim then called the police for assistance.
The suspect and his nephew went to the hospital and had their wounds caused by the shattered glass treated.
