Law firm sues client for failure to pay legal fees

Pacific Lawyers, which is doing business as O’Connor Berman Dotts & Banes, filed the complaint against Woo Jung Corp., which is doing business as Sang Jee Rent a Car.

Pacific Lawyers is asking the Superior Court to render judgment against the defendant for $5,592.59 in general damages, plus lawful interest, for additional attorney’s fees and costs incurred in this action, and for other relief the court may deem just and equitable.

The plaintiff stated that sometime in Feb. 2008, the defendant employed Pacific Lawyers to render legal services and represent the defendant in matters concerning the transfer of the company’s assets.

The plaintiff said the services continued through May 2008.

Pacific Lawyers said  the defendant agreed to pay for attorney’s fees and costs incurred in the course of the legal representation.

The defendant also agreed to reimburse the plaintiff for all out-of-pocket expenses, including but not limited to filing fees, court costs, travel expenses and duplication charges as well as other unpaid balances.

The plaintiff said it worked diligently on behalf of the defendant and spent considerable time, work and energy in representing the defendant.

 The plaintiff said the defendant incurred an unpaid balance of $3,592.59 which the defendant failed and neglected to pay despite repeated demands.

The plaintiff is filing two causes of action against the defendant for breach of contract and unjust enrichment.

The plaintiff said the defendant received benefits as a result of the legal representation and it would be unjust for the defendant to retain such benefits without compensating the plaintiff.

The court has ordered the defendant to file an answer within 20 days after receipt of the summons.
