Ou was directed to attend all court appearances, to report to pretrial services at the U.S. Probation Office, and to follow the pretrial release conditions imposed by the court.
He was found to be indigent, and the court will appoint a defense attorney for him.
An interpreter assisted the defendant.
Assistant U.S. Attorney General Eric S. O’Malley is the prosecutor.
Judge Houston ordered the unsealing of the case, and Ou’s arraignment tomorrow.
Special Agent Garrett Chinn of the U.S. FDA’s Office of Criminal Investigation, said their office and the U.S. Immigration and Customs Enforcement’s Homeland Security Investigations were investigating Su Us Mart which is being operated by Ou.
Chinn said the defendant purchased unapproved erectile dysfunctional drugs manufactured in China and sold them in his retail store via cash transactions.
On Feb. 14, 2011, at about 1:55 p.m., an undercover agent entered Ming Li Store, which is doing business as L&Q Store in Garapan St., and tried to buy an erectile dysfunctional drug from a female store attendant, the wife of the defendant.
The wife said she did not have it, but her husband, the defendant, had the drugs at their other store called “Chian Jiang,” later identified as Su Us Mart, located across the street from the Hyatt Regency Hotel.
At about 2:05 p.m. on same day, the undercover agent went to the defendant’s store on Coral Tree Ave., where the defendant met the undercover agent.
The defendant subsequently retrieved some tablets in blister packs from the storage room after the undercover agent asked for erectile dysfunctional drugs on sale.
The tablets resembled the same blue diamond-shaped as the prescription drug Viagra, with imprinted marking “VAG.”
The undercover agent purchased 17 tablets, worth $70.
The defendant was selling the tablet $5 per piece.
On Feb. 17, 2011, the undercover agent was able to purchase from the defendant an additional 12 pieces of Viagra-resembling tablets from the defendant, amounting to $48, at the same store.
