U.S. District Court for the NMI Chief Judge Alex R. Munson also ordered 52-year-old James Ochcha to pay $11,830.13 immediately after the sentencing.
This is a third of the total $35,490.40 restitution he and his two co-defendants must pay. He was also ordered to pay $200 in special assessment fee.
Ochcha appeared with his counsel, Robert Torres, while the federal government was represented by Assistant U.S. Attorney Beverly McCallum.
Munson imposed the four-month jail term on the defendant for each of the two separate offenses charged against him, but the sentences will run concurrently and Ochcha will get credit for time already served.
Munson said the defendant will be delivered to immigration officials for deportation to Chuuk after serving his sentence.
Once deported the defendant cannot reenter the United States without permission from the U.S. attorney general.
The defendant is also prohibited from committing another federal, local or state crime; from taking any alcohol or from possession of any uncontrolled substances.
He must subject himself to a drug test 15 days after release, and submit to two periodic tests thereafter.
He must undergo a treatment program approved by the U.S. Probation office, and render 100 hours of community work service.
The federal government moved to dismiss the other charges in the indictment against the defendant.
Ochcha was indicted for conspiring with Dominic Chipwelong and Masaoishy Daikichi Sallem in stealing and selling metal lighting units with an estimated value of more than $1,000 from American Memorial Park in November last year.
Ochcha pleaded guilty to the charges in July.
The indictment stated that Ochcha accompanied Chipwelong on Nov. 1, 2007 to sell a portion of the metal lighting units they stole to the employees of the Huang Zheng Recycling Center.
