Man in assault and battery case gets six-month jail term

Associate Judge Ramona V. Manglona also gave Cleofin Nesis Masao credit for time served in jail from the date of his arrest on Jan. 7, 2009.

She placed him on three-year probation under the supervision of the Office of Adult Probation.

Masao was ordered to pay a $300 fine and a court assessment fee of $25 to be paid within 30 days. He will have no contact with the victim unless permitted by a court order.

He must  participate in any available counseling as recommended by the Office of Adult Probation, seek and/or maintain a full time job, and obey all CNMI and dederal laws as well as the rules, requirements and conditions of the probation office.

Manglona said failure to comply with the conditions “shall constitute a violation of the terms of the suspended sentence and shall subject the defendant to revocation proceedings.”

Manglona ordered the defendant to return to court for a review hearing on Aug. 19.  

The defendant, represented by Assistant Public Defender Richard Miller, entered into a plea agreement with the government on June 3, 2009. Chief prosecutor Kevin Lynch represented the government.

In exchange for the defendant’s guilty plea and imposition of the sentence recommended, the government agreed not to file charges for any other offenses arising out of the defendant’s arrest in this case.

The Attorney General’s Office filed charges against the defendant on Jan. 15, 2009 for assaulting the victim, a crime which involved domestic violence.
