Man in illegal casino case sued for ‘corporate hijacking’

Blue Bird Inc. through its counsel Ramon K. Quichocho filed the complaint against Byung Seob Choi, his brother Byong Kook Choi, Kyung Hee Joo, Bo Kyun Choi and Pacific Rota for “corporate hijacking.”

The plaintiff wants to be awarded general and compensatory damages, temporary, preliminary and permanent injunctive relief to prevent any corporate hijacking, for punitive damages in the amount to be proven at trial based on the intentional nature of the defendants’ misconduct, prejudgment interest on amounts owed, post-judgment interest and other relief as the court deems proper.

Blue Bird stated in its complaint that it engaged Byung Kook Choi to manage the corporation.

On Dec. 30, 2003, the Choi brothers convened a meeting with the board of directors of Blue Bird.  Byung Kook Choi was elected president and treasurer, and Byong Seob Choi as vice president and secretary.

The plaintiff opened the Songsong and Sinapalo poker game rooms on Rota in 2004.

Byung Kook Choi managed the operations but he failed to remit money to Blue Bird, the complaint stated.

The plaintiff added that Byung Seob Choi filed an annual corporation report for Blue Bird in 2004 stating that he and his brother were the sole directors, officers and shareholders of Blue Bird.

Blue Bird added that the brothers made a lot of money but failed to remit the funds.

The complaint stated that in 2007, Byung Kook Choi changed Blue Bird’s name to Pacific Rota without the plaintiff’s permission.

The defendants also transferred the poker machines that were in Songsong to Pacific Rota.

The plaintiff  filed four causes of action against the defendants — breach of fiduciary duty against Byung Kook Choi, and conversion, accounting and injunction against all the defendants.

Last week, Judge Kenneth Govendo sentenced Byung Seob Choi to two years of supervised probation and one year unsupervised.

Govendo ordered him to pay a fine of $4,000.

He also ordered the forfeiture of tables, chairs and gambling paraphernalia including the seized cash money amounting to $11,933.00.

Byung Seob Choi was charged with Hideo Kato for running an illegal casino at the Victoria Hotel in Garapan in 2007.
