“Due to the age of the case, the commonwealth has determined not to pursue the prosecution,” Lynch informed the Superior Court.
The chief prosecutor said the counsel of defendant Sung Hoon Chung, a.k.a. Terry of Chalan Kanoa, does not object to his motion.
Records showed the information was filed on Nov. 10, 2005. The slapping incident happened on Oct. 22, 2005.
“The commonwealth issued a penal summons with an appearance date of Dec. 5, 2005. The penal summons was not served and the case has been off calendar since that date,” Lynch said.
Chung was arrested and posted bail to secure his pretrial release, records showed.
“For the foregoing reasons, the commonwealth asks that this court dismiss this case and to exonerate the bail to the posting party,” Lynch stated.
Investigation at the time by Detective Christopher Leon Guerrero showed that Chung slapped his wife after she arrived at her apartment on the night of Oct. 22, 2005.
