Superior Court Judge Perry B. Inos retained the $1,750 bail order on Fitial who is being held on charges of assault and battery, assault, and disturbing the peace.
The court also directed Fitial not to have any contact with the victim — his common-law wife.
Fitial was remanded to the custody of the Department of Corrections after his initial appearance and bail hearing yesterday morning.
Assistant Attorney General Peter Prestley represented the government while Assistant Public Defender Matthew Meyer was appointed by the court as Fitial’s counsel.
Detective Peter A. Aldan said the incident occurred last Friday, between 1 and 4 a.m. at the defendant’s residence on Ubas St. in Kagman III.
Police said the victim was sleeping in the bedroom when Fitial arrived at about 1 a.m., and started banging on the window shutters.
Fitial was under the influence of alcohol, the victim told police.
While walking toward the front door, Fitial hit the victim on her head, kicked her on her right leg, and slapped her face with his left hand “real hard,” Aldan said.
“[The victim] felt dizzy but managed to walk to the front door. [She] told Ray to stop what he was doing. Ray told her that he could kill her,” Aldan said, quoting the victim.
Once inside the house, the victim asked Fitial if he wanted to eat, but the defendant refused, and told the victim to get him beer.
After showing Fitial one can of beer from the ice box, the victim said the defendant “was unhappy.”
The victim said Fitial “told her to get out of the house because his head was going crazy.”
“[The victim] was scared for her life [so] she immediately grabbed her slippers and ran out of the front door to her neighbor’s house to seek assistance in calling the police,” Aldan said.
The victim informed responding officer that “this was not the first time” Fitial physically assaulted her and “for the times he did she just wanted to keep it to herself.”
