Patu Tiavaasue granted the declaratory order against the speaker which means all the Tautua Party MPs are to return to their seats for the next parliamentary session commencing Aug. 7.
He said the court was not satisfied with the evidence presented by the first respondents to support the speaker’s decision.
After the justice delivered his decision the Tautua Party MPs and supporters held a prayer service of thanksgiving outside the court.
On May 29, Speaker Tolofuaivalelei Falemoe Leiataua announced that the Tautua Party members had been disqualified as MPs after they formed a new political party despite their already sworn allegiances.
Tautua filed an injunction against the decision and party members also called for the speaker resignation if they win the case.
