The Samoan serving with the Regional Assistance Mission to Solomon Islands was driving the vehicle involved in the accident in which a young woman died more than two weeks ago.
Under an act of parliament, members of RAMSI are immune from prosecution by local authorities.
Marshall told Radio Australia’s Pacific Beat program that police will complete their investigation into the case and report to the director of public prosecutions.
He said police will not be part of the decision whether the officer will be charged under the RAMSI facilitation act.
“The file will go to the attorney general, and then it will be essentially a discussion between the Solomon Islands government and the Samoan government,” he said. “What they do in the context of the Facilitation Act is a matter for the government, and I can’t speculate at all at this stage as to what the outcome might be.”
