Wells Fargo seeks foreclosure of couple’s property

Gregory J. Koebel, counsel for Wells Fargo, said Grina Mizutani and wife Barbara owed the financial firm $87,952.94 as of March 8 this year.

The couple are being sued over breach of contract, unjust enrichment, conversion and foreclosure of mortgage.

Wells Fargo is seeking “judgment over and against defendants as follows: a. for principal amount of $83,009.24 due on the promissory note; b. for pre-judgment interest of $3,543.04 at 8.13 percent interest from August 27, 2010 to March 8, 2011; c. pre-judgment interest at 8.13 percent from March 9, 2011 to date of judgment; [and] d. for post-judgment interest of 9 percent per annum from date of judgment until the same is fully paid.”

Wells Fargo is also asking the court to order the foreclosure of the property used to secure the loan and have it sold so that the proceeds of the sale can be applied as payments to the financial firm.
