Cosmes’ victim had a stroke, the court was told during the change of plea hearing on Friday.
Wiseman imposed a sentence of 10 years imprisonment for assault with a dangerous weapon on the 25-year-old Cosmes, all suspended except for the first four years without the possibility of parole.
The court imposed another four years on Cosmes for violating his probation.
Both sentences will be concurrent, and the court credited the time already served by Cosmes since his arrest last May.
After his release from prison, Cosmes will be placed under supervised probation for the remaining of his suspended sentence.
Cosmes was required to pay a $500 fine, a $100 court assessment fee and probation fee to be assessed by the Adult Probation Office. He will perform 100 hours of community work service.
Cosmes was charged with assault with a dangerous weapon, assault and battery, and kidnapping by the Attorney General’s Office.
Upon the acceptance of the plea agreement by the court, the prosecution moved for the dismissal of assault and battery, and kidnapping charge.
Assistant Attorney General Brian D. Gallagher represented the government while Assistant Public Defender Michael Brown served as Cosmes’ counsel.
According to the factual basis for plea, Cosmes assaulted his victim with a piece of wood on May 22 or 23, 2009.
